By creating an account or using the Service, you agree to the following terms

1. Introduction

This End User License Agreement ("Agreement") governs your use of the SaaS platform ("Service"), operated by STACKS SOFTWARE ("Company," "we," "our," or "us"). By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by this Agreement. No physical signature is required. Your acceptance occurs automatically upon creating an account or using the Service.

2. License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service solely for lawful purposes and in accordance with this Agreement.

3. User Content and Uploaded Materials

You may submit files, URLs, malware samples, documents, images, or other materials ("User Content") for the purpose of analysis, scanning, or classification.

    3.1 Use of Malware Samples, URLs, and Threat Intelligence

    You grant the Company a non-exclusive, global, royalty-free right to use malware samples, suspicious URLs, or threat-related material you upload for the purposes of:

    • improving our machine-learning models,
    • enhancing detection accuracy,
    • conducting internal security research, and
    • strengthening overall threat intelligence capabilities.
    • This limited license is necessary for the operation and improvement of the Service.

    3.2 No Storage of Documents or Photos

    For documents, images, photos, PDFs, identification materials, or other personal files unrelated to malware/URL classification , the Company:

    • does not store persistent copies
    • does not index, reuse, or retain content
    • processes the material only in-memory for the duration of analysis, and
    • automatically deletes all temporary data immediately after processing.

    You retain full ownership and confidentiality of uploaded images, and documents

4. Privacy & Data Protection

We value and protect your privacy. Our practices include:

  • Encryption of data in transit and at rest (where applicable)
  • Strict internal access controls
  • Zero retention of personal documents and photo uploads
  • Segregated storage for anonymized malware/URL samples used for model improvement
  • Ongoing security monitoring, logging, and auditing

We do not sell, lease, or otherwise monetize your personal data.

Full details of data handling practices are described in our Privacy Policy, which forms an integral part of this Agreement.

5. User Responsibilities

You agree not to:

  • Upload illegal content other than malware samples or URLs for legitimate security testing and research
  • Use the Service to distribute malicious software
  • Attempt to reverse engineer, copy, or interfere with the Service’s infrastructure
  • Violate any applicable laws or regulations

You represent and warrant that you have the legal right to upload and process any User Content submitted.

6. Service Availability & Modifications

We reserve the right to modify, update, or discontinue the Service at any time. We will make reasonable efforts to avoid disruptions, but uninterrupted service is not guaranteed.

7. Disclaimer of Warranties

The Service is provided "as-is" and "as-available." We make no warranties, express or implied, regarding:

  • accuracy of classifications or detections,
  • fitness for a particular purpose, or
  • uninterrupted or error-free operation.

8. Limitation of Liability

To the maximum extent permitted by law:

The Company is not liable for any indirect, incidental, special, consequential, or punitive damages including loss of data, loss of business, loss of profits, or service interruptions. Your sole and exclusive remedy is to discontinue use of the Service.

9. Data Breach Liability Release

While we take industry-standard measures to protect your data, you acknowledge and agree that:

  • No system is perfectly secure.
  • You release the Company from liability for any damages arising from unauthorized access, breaches, cyberattacks, or data exposures, except where prohibited by applicable law.
  • We will provide notice of any breach as required by law and take reasonable corrective measures.

10. Termination

We may suspend or terminate your access at our discretion for violations of this Agreement or misuse of the Service. Upon termination, your license ends immediately.

11. Governing Law

This Agreement is governed by the laws of Delaware. Any disputes shall be resolved in the courts of Delaware, unless otherwise required by applicable law.

12. Changes to the Agreement

We may update this Agreement from time to time. Continued use of the Service constitutes acceptance of any modifications.
